Warranty Statement

Product Satisfaction Guarantee:
Nitney Corporation offers a 60-day satisfaction guarantee. If for any reason you are not satisfied with your purchase, you may return it in the original packaging, in good condition within 60 days from shipping date, for a full purchase price refund.

Extent of Limited Warranty:
Nitney Corporation warrants to the end-user customer that all Paddington II/G™ parts will be free from performance defects for a period of one year from original shipping date. Nitney Corporation’s limited warranty covers only those defects that arise as a result of normal use of the product, and does not cover any other problems, including those that arise as a result of improper maintenance, modification or misuse.
In the event of a part defect within the one-year warranty, Nitney Corporation will remedy the defect, without charge to the customer.
To obtain performance by Nitney Corporation of it’s obligation under this warranty the customer must return the defective product, carefully packed in its original carton or other suitable carton to avoid damage in shipping; freight prepaid to Nitney Corporation. Or, Nitney Corporation will provide to the customer the replacement part at no cost for the customers self installation. Nitney Corporation reserves the right to require any failed part to be returned to Nitney Corporation for inspection as to cause of failure. If the failed part is not returned to Nitney Corporation when required, the customer will be responsible for the costs of the replacement part.

Limitation of Warranty:
TO THE EXTENT ALLOWED BY LOCAL LAW, NEITHER NITNEY CORPORATION NOR ITS THIRD PARTY SUPPLIERS MAKES ANY OTHER WARRANTY OR CONDITION OF ANY KIND, WHETHER EXPRESS OR IMPLIED OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Liability:
THE REMEDIES PROVIDED IN THIS WARRANTY STATEMENT ARE THE CUSTOMER’S SOLE AND EXCLUSIVE REMEDIES. IN NO EVENT SHALL NITNEY CORPORATION OR ITS THIRD PARTY SUPPLIERS BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY AND WHETHER ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state.
